1. Who we are

groundedperformanceatx.com (the "Website") is operated by Grounded Functional Fitness LLC, doing business as Grounded Performance and Grounded Performance ATX ("Grounded Performance," "we," "us," or "our"), a gym at 12400 Amherst Drive, Unit 104, Austin, Texas 78727. 2. What this policy covers

This policy explains what information we collect through the Website, how we use and share it, and the choices you have. It also covers the emails and text messages we send to people who give us their contact information through the Website.

Some services we link to have their own privacy policies, and this policy does not cover them:

• Memberships, trials, class booking, payments, and the Grounded Performance booking app are provided through our membership platform, PushPress, under your membership agreement and PushPress's privacy policy.
• The GP Fit app is covered by the GP Fit Privacy Policy at groundedperformanceatx.com/gp-fit/privacy.
• ClassPass, Google, Facebook, Instagram, the Apple App Store, and Google Play each have their own privacy policies.

3. Information we collect

Information you give us

• Contact and consultation forms: your name, email address, phone number, and anything you write in the form, such as your questions, preferred start date, or fitness goals.
• Event registration: when an event offers registration on the Website, your name, email address, phone number, and any event-specific question on the form.
• Your marketing choices: whether you checked the email or text message boxes on a form, with the date and the wording you agreed to.
• Messages to us: information you send when you email, call, or text us.

Information collected automatically

When you visit the Website, our server records basic technical information needed to deliver and secure the Website, such as your IP address, browser type, and the page you requested.

If you accept analytics or advertising cookies (Section 6), we and our partners also collect information about your visit, such as the pages you view, how you arrived at the Website (for example, from an ad or a search), the device and browser you use, your approximate location based on your IP address, and actions you take, such as submitting a form.

Information from other sources

• PushPress: if you book, buy a membership, or sign up for a trial, PushPress handles that information under its own policy, and we receive it to run your membership.
• ClassPass: when you book a class through ClassPass, we receive your first name, last initial, and booking details.
• Advertising and analytics partners: Google and Meta give us reports about how our ads and Website perform. These reports are generally aggregated and do not identify you to us.

4. How we use your information

We use your information to:

• Respond to your questions and consultation requests and help you get started at the gym.
• Register you for events and send you event details and reminders.
• Send you emails and text messages you agreed to receive (Section 5).
• Understand how people use the Website and improve it, if you allow analytics cookies.
• Measure our ads and show you relevant Grounded Performance ads on other sites and apps, if you allow advertising cookies.
• Keep the Website secure, prevent spam and fraud, and keep records of the consent you gave.
• Meet legal obligations and enforce our Website Terms of Service.

5. Emails and text messages

Replies to your request. When you submit a form, we will contact you by email or phone to respond to your request, even if you do not check either marketing box.

Marketing emails. Each form has a separate, optional box for email. If you check it, we will send you newsletters, promotions, and news through PushPress. Every marketing email has an unsubscribe link, and you can also email info@groundedperformanceatx.com to stop them.

Text messages. Each form has a separate, optional box for text messages. If you check it, we will text you about community events, seminars, and gym updates. Message frequency varies. Message and data rates may apply. Reply STOP to opt out at any time, or HELP for help, or call (512) 661-0745. Consent to receive text messages is not a condition of any purchase.

Members. If you become a member, PushPress also sends operational texts and emails about your account, such as class sign-up confirmations and reminders, as described in your membership agreement.

We do not sell, rent, or share your mobile phone number or your text message consent with any third party for its own marketing. We share them only with the service providers that deliver our messages.

6. Cookies, analytics, and advertising

Cookies are small files stored by your browser. When you first visit the Website, a banner lets you accept all cookies, reject all optional cookies, or choose by category:

• Strictly necessary: required for the Website to work, such as remembering your cookie choice and protecting our forms from spam. These are always on.
• Analytics: Google Analytics helps us understand how visitors use the Website. Off until you allow it.
• Advertising: the Meta Pixel and Google advertising tags help us measure our ads on Facebook, Instagram, and Google and show Grounded Performance ads to people who visited the Website. Off until you allow it.

You can change your choice at any time with the Cookie Settings link at the bottom of every page. If your browser sends a Global Privacy Control signal, we treat it as a request to opt out of advertising cookies.

You can also limit ads through Google's Ad Settings (adssettings.google.com) and Meta's ad preferences in your Facebook or Instagram settings, and you can install the Google Analytics opt-out browser add-on (tools.google.com/dlpage/gaoptout). We do not respond to "Do Not Track" browser signals, because there is no common standard for them, but we do honor Global Privacy Control as described above.

7. How we share information

We do not sell your personal information for money. We share information only as described here:

• Service providers that help us run the Website and our business, such as PushPress (lead management, email, text messages, and booking), Google (analytics, advertising, and maps), Meta (advertising), and our website hosting and email delivery providers. They may use your information only to provide services to us, except that Google and Meta also use advertising cookie data as described in their own policies, which is why those cookies are off until you allow them.
• Event hosts. Sometimes an outside instructor or business hosts an event or seminar at our gym. If you register for one of those events, we share your name and contact information with the host only when the registration form says so and you agree.
• Legal and safety reasons. We may disclose information if required by law, subpoena, or court order, or to protect the safety of our members, staff, or the public.
• Business transfers. If our business is sold or merged, information may transfer to the new owner, who must honor this policy or notify you of changes.

8. Photos, reviews, and testimonials

Photos. The Website shows photos of our gym, classes, and events. We feature members in photos and videos under the Media Release Agreement members sign when they choose a membership. Our events may be photographed or filmed. If you prefer not to be photographed, tell a coach. If you would like a photo of you removed from the Website, email info@groundedperformanceatx.com and we will remove it within 30 days.

Reviews. Reviews on the Website come from Google and are shown with the reviewer's name as it appears publicly on Google. To change or remove a review, edit it on Google or email us.

9. Children

The Website is for a general audience and is not directed to children under 13. We do not knowingly collect personal information from children under 13. Forms on the Website must be completed by an adult 18 or older. Where an event welcomes families, a parent or guardian registers on the child's behalf. If you believe a child under 13 has given us personal information, email info@groundedperformanceatx.com and we will delete it.

10. How long we keep information

• Contact and consultation requests: up to 24 months after our last contact with you, unless you become a member, in which case your information becomes part of your membership records.
• Event registrations: up to 12 months after the event.
• Records of your marketing consent and opt-outs: up to 5 years, so we can show what you agreed to and honor your opt-out.
• Analytics data: Google Analytics keeps visit data for 14 months.
• Your cookie choice: 12 months, after which we ask again.

We may keep limited records longer when the law requires it or to resolve disputes.

11. Security

We protect your information with encryption in transit, access limited to staff who need it, and spam and abuse protections on our forms. No method of transmission or storage is completely secure. If a security incident affects your personal information, we will notify you as the law requires.

12. Your choices and rights

• Marketing emails: use the unsubscribe link in any email.
• Text messages: reply STOP.
• Cookies and targeted advertising: use the Cookie Settings link or a Global Privacy Control signal.
• Access, correct, delete, or get a copy of your information: email info@groundedperformanceatx.com.
• Additional rights where you live: depending on your state, including Texas, you may have rights to access, correct, delete, or obtain a copy of your personal information, to opt out of targeted advertising, the sale of personal information, and certain profiling, and to appeal our decision on a request. To use these rights, email info@groundedperformanceatx.com with the subject "Privacy Request." We may need to verify your identity before acting on a request. We will respond within 45 days. If we deny your request, you may appeal by replying to our decision, and we will respond to the appeal within 60 days. If we deny your appeal, you may contact the Texas Attorney General. We will not discriminate against you for using these rights.

13. Links to other websites

The Website links to services we do not control, including PushPress, ClassPass, the Apple App Store, Google Play, Google Maps, Facebook, and Instagram. Their privacy practices are governed by their own policies.

14. Where your information is stored

Grounded Performance is based in Austin, Texas, and we store Website information in the United States. If you visit from outside the United States, your information will be transferred to and processed in the United States.

15. Changes to this policy

If we change this policy, we will post the updated version on this page with a new effective date. If we make a material change to how we use information you already gave us, we will notify you by email or with a notice on the Website before the change takes effect.
